This Agreement is between Deals 4 U LLC, d/b/a Donate Consign, hereinafter, “Dealer” and hereinafter “Consignor(s).” Deals 4 U LLC is a licensed independent motor vehicle in the State of Florida.
1- Consignor(s) warrant that the above referenced vehicle is free and clear of all liens and that the title is “marketable” as defined under Florida Statutes. Consignor(s) also warrant that a paper title for the vehicle will be provided upon pick up by or delivery to Dealer or its agents.
2- Dealer shall not be responsible for any theft, damage or resulting depreciation to the vehicle, its components or its contents, etc., while on consignment. Consignor(s) shall maintain full insurance coverage (comprehensive and liability) on the vehicle during the term of this consignment agreement and during any extensions thereof, until instructed by Dealer to remove said insurance.
3- Consignor(s) expressly authorize Dealer and its agents, employees or servants, etc., to drive and use the vehicle for any purpose, including but not limited to: demonstration, display, private or public offerings, repairs and related services, etc.
4- Consignor(s) grant Dealer the exclusive right to sell the vehicle during the term of this consignment agreement and during any extensions thereof.
5- This consignment agreement will commence on and will continue for the next 30 days until the vehicle is sold or this consignment agreement expires on .
6- Dealer and Consignor(s) may extend the term of this consignment agreement if desired. Consignor(s) agree to accept $ for the vehicle. This is known as the “net amount” to be paid to Consignor(s). The “net amount” may be amended by Dealer and Consignor(s) if desired.
7- Dealer has the right to sell the vehicle at or above the “net amount,” without consulting with Consignor(s). Any amount of money earned above the “net amount” shall be retained by Dealer as its commission. Dealer will remit the “net amount” to Consignor(s) within two (2) weeks after said funds are available to be paid out of Dealer’s bank account.
8- If the vehicle does not sell during the term of this consignment agreement, Consignor(s) will pay all of Dealer’s fees for advertising, auction services, detailing, repairs and transportation, etc., upon Dealer’s request, before he/she picks up the vehicle.
9- This consignment agreement will be interpreted in accordance with the laws of the State of Florida. All claims, disputes and lawsuits, etc., involving this consignment agreement must be brought in Collier County, Florida.
10- Consignor(s) hereby agree to defend, indemnify and hold Dealer, its agents, employees or servants, etc., harmless from any and all claims, disputes and lawsuits, etc., involving said vehicle, in consideration for Dealer’s acceptance of this consignment agreement.
This consignment agreement constitutes the entire agreement between Dealer and Consignor(s). By signing below, Consignor(s) warrant that he/she have read, understand and accept all of the terms of this consignment agreement.
